ZULEADS TERMS OF SERVICE

Welcome to Zuleads, a brand of Zusystem (“we,” “our,” or “us”). These Terms of Service (“Terms”) govern your use of the Zuleads website and lead generation services (the “Site”).

By using our Site and services, you expressly agree to these Terms. If you do not agree, you must discontinue use immediately.

Zuleads may update these Terms at any time. Your continued use of the Site constitutes acceptance of the latest version.

1. BUSINESS MODEL DISCLOSURE & USER CONSENT

Zuleads is a lead generation service. We collect and distribute consumer inquiries to third-party businesses (such as solar companies) that may contact users with offers.

By using Zuleads, you expressly agree and consent to:

  • Your contact information being sold or transferred to third-party companies.
  • Being contacted by phone, email, or SMS by these companies.
  • Receiving notification from Zuleads when your information is transferred.
  • Zuleads NOT being responsible for third-party services, pricing, contracts, or interactions.

2. LICENSE TO USE THE SITE

Zuleads grants you a limited, non-exclusive, non-transferable license to use the Site for personal purposes only.

You agree not to:

  • Modify, copy, distribute, or exploit any content from the Site.
  • Use bots, scrapers, or automated tools to collect data.
  • Interfere with or bypass any Site security features.

3. NO GUARANTEE OF LEAD QUALITY OR CONVERSION

⚠️ ALL LEADS ARE SOLD “AS IS” WITHOUT WARRANTY

Zuleads does not guarantee:

  • The accuracy, completeness, or timeliness of lead information.
  • That leads will result in successful contact, appointments, or sales.
  • That leads will meet any specific quality or exclusivity standards.

ALL SALES ARE FINAL. NO REFUNDS OR EXCHANGES.

4. THIRD-PARTY COMPLIANCE & LIABILITY DISCLAIMER

⚠️ Zuleads is NOT responsible for third-party telemarketing or sales practices.

  • Third-party buyers of Zuleads leads are fully responsible for their own compliance with:
    • The Telephone Consumer Protection Act (TCPA)
    • The Telemarketing Sales Rule (TSR)
    • State Do Not Call (DNC) regulations
  • Zuleads does not control or oversee how third-party buyers use lead information.
  • If you receive unwanted or illegal calls, you must opt out directly with the third-party company.

5. INDEMNIFICATION FOR THIRD-PARTY VIOLATIONS

By purchasing or using Zuleads leads, you agree to indemnify, defend, and hold harmless Zuleads and its affiliates from any:

  • Fines, lawsuits, claims, or penalties resulting from the third-party buyer’s telemarketing practices.
  • TCPA or TSR violations committed by third-party buyers.

⚠️ Zuleads assumes ZERO liability for any legal actions taken against lead buyers.

6. DATA ACCURACY DISCLAIMER

Zuleads does not verify the accuracy of consumer-submitted data. Lead buyers accept all risks related to:

  • Incorrect or outdated contact information.
  • Consumers changing their preferences after opting in.

7. REFUND POLICY

🚫 ALL SALES ARE FINAL. NO REFUNDS.

By purchasing leads, you agree that:

  • Zuleads does not offer refunds, exchanges, or credits for any reason.
  • The success or conversion rate of leads is solely your responsibility.

8. DISPUTE RESOLUTION & ARBITRATION

⚖️ All disputes must be resolved through binding arbitration.

  • No class-action lawsuits.
  • Arbitration will be conducted under JAMS Rules.
  • Venue will be in your state of residence.

9. GOVERNING LAW

These Terms shall be governed by U.S. law. Any disputes shall be resolved in your state of residence, unless arbitration applies.
